De inspecteur heeft deze nabetaling volledig gerekend tot het belastbaar inkomen in 2018. Als gevolg hiervan moet de man de toeslagen die hij in 2018 heeft ontvangen terugbetalen. Ook moet hij een bedrag terugbetalen aan het UWV. Gelet op de nadelige gevolgen van de toerekening van de nabetaling aan het jaar 2018, wil de man dat de nabetaling wordt verdeeld over de jaren 2007 tot en met 2018.<\/p>\n<h4>Vorderbaar en inbaar&nbsp;<\/h4>\n<p>Het hof oordeelt dat het niet mogelijk is om de nabetaling uit het inkomen van 2018 te halen en alsnog toe te rekenen aan de voorgaande jaren. Loon of periodieke uitkeringen worden geacht te zijn genoten op het tijdstip dat deze zijn ontvangen, verrekend, ter beschikking zijn gesteld, rentedragend zijn geworden of vorderbaar en inbaar zijn geworden. De man heeft de pensioenuitkering pas in 2018 aangevraagd en ook pas in 2018 toegewezen gekregen. In de eerdere jaren bestond dus weliswaar een vorderbare uitkering, maar die was nog niet direct inbaar.
