De Kamer van Koophandel (KVK) heeft onlangs het Trendrapport tweede kwartaal 2025 gepubliceerd. Een trend die de KVK hierin signaleert, is dat steeds meer starters kiezen voor een besloten vennootschap (bv). In het tweede kwartaal van 2025 waren dit er 10.611, een stijging van 21% ten opzichte van het tweede kwartaal van 2024. De KVK wijst als mogelijke oorzaak op de nieuwe wetten en regels die gelden voor eenmanszaken, zoals de handhaving op schijnzelfstandigheid. <\/p>\n

Sergej Schuurman, jurist en contentredacteur bij de KVK, legt hierover uit: ‘Er heerst een idee dat met een bv risico’s omzeild worden als het gaat om de beoordeling bij schijnzelfstandigheid, maar dat is pertinent niet waar. Er gelden dezelfde beoordelingscriteria voor een eenmanszaak en een bv. Zo mag er bijvoorbeeld ook bij een bv geen gezagsverhouding zijn tussen de opdrachtgever en de zelfstandige’.
