Het beroep is volgens de rechtbank ingediend door iemand die daartoe niet is gemachtigd.<\/p>\n<p>Hof Amsterdam heeft de uitspraak van de rechtbank vernietigd. Wanneer bij het instellen van beroep geen schriftelijke machtiging is overgelegd, stelt de rechter degene, die het beroep heeft ingesteld, in de gelegenheid om alsnog een schriftelijke machtiging over te leggen. Het hof ziet geen aanleiding om anders te handelen in het geval de overgelegde machtiging niet meer geldig is. Dat betekent dat de rechtbank het beroep ten onrechte niet-ontvankelijk heeft verklaard.
