{"id":3710,"date":"2024-03-28T04:00:00","date_gmt":"2024-03-28T04:00:00","guid":{"rendered":"im-57187"},"modified":"-0001-11-30T00:00:00","modified_gmt":"-0001-11-30T00:00:00","slug":"wijziging-civiel-bewijsrecht","status":"publish","type":"post","link":"https:\/\/fortiusaccountants.nl\/index.php\/2024\/03\/28\/wijziging-civiel-bewijsrecht\/","title":{"rendered":"Wijziging civiel bewijsrecht"},"content":{"rendered":"<p>Het bewijsrecht omvat de regels voor het moment en de manier waarop partijen in een civiele procedure bewijs mogen of moeten leveren van de feiten die zij aanvoeren ter onderbouwing van hun vordering, verzoek of verweer. Het bewijsrecht bevat regels voor de waardering, die de rechter aan geleverd bewijs kan toekennen. Het bewijsrecht is het uitgangspunt voor welke partij in een procedure de bewijslast draagt.<\/p>\n<p>De Wet vereenvoudiging en modernisering bewijsrecht treedt in werking per 1 januari 2025. Per die datum worden de volgende wijzigingen ingevoerd.<\/p>\n<ul>\n<li>De rechter kan in &eacute;&eacute;n verzoek worden gevraagd om verschillende bewijsverrichtingen toe te staan, zoals de combinatie van een getuigenverhoor en een deskundigenonderzoek.<\/li>\n<li>De regels voor het recht op inzage in stukken van de wederpartij worden verduidelijkt. Het inzagerecht gaat ook gelden voor moderne vormen van informatie, zoals computerbestanden. Het inzagerecht kan ook worden gebruikt voor relevante documenten, die in het bezit zijn van derden, die geen partij zijn in het geschil.<\/li>\n<li>De wet verduidelijkt dat de rechter de ruimte heeft om actief met partijen te spreken over de door hen aangevoerde feiten. Zo kan de rechter voorkomen dat bepaalde feiten op de zitting onbedoeld onderbelicht blijven of dat de rechter daaraan een uitleg geeft die de partijen niet hadden bedoeld of waarop de partijen niet bedacht waren.<\/li>\n<li>In de wet is vastgelegd dat het mogelijk is om bewijsmateriaal veilig te stellen door daarop beslag te laten leggen door een gerechtsdeurwaarder.
