In de Wet arbeid vreemdelingen is geregeld dat asielzoekers maximaal 24 weken in een periode van 52 weken mogen werken. De Afdeling bestuursrechtspraak van de Raad van State heeft onlangs geoordeeld dat deze zogeheten 24-weken-eis in strijd is met de Europese Opvangrichtlijn. Deze richtlijn bevat normen voor de opvang van asielzoekers en bepaalt dat asielzoekers daadwerkelijke toegang dienen te krijgen tot de arbeidsmarkt. <\/p>\n

De uitspraak van de Raad van State betekent dat de 24-weken-eis onverbindend is en niet meer zal worden toegepast. Als gevolg hiervan moet de regelgeving worden aangepast. Het UWV past vanaf 29 november 2023 (de datum van de uitspraak) niet langer de 24-weken-eis toe bij aanvragen om een tewerkstellingsvergunning voor asielzoekers. Asielzoekers, van wie de asielaanvraag ten minste zes maanden in behandeling is, mogen werken mits aan de werkgever een tewerkstellingsvergunning is afgegeven. De tewerkstellingsvergunning kan vanaf dit moment worden afgegeven voor een duur van langer dan 24 weken. De tewerkstellingsvergunning heeft een geldigheid van maximaal de duur van het Vreemdelingen Identiteitsbewijs, waarmee de asielzoeker kan aantonen rechtmatig in Nederland te verblijven.<\/p>\n
